Vacation Rental Agreement

VACATION RENTAL AGREEMENT


 

This document is a legal Agreement between the homeowner (also referred to as the “Owner”) and you, the person placing the reservation who must also be the holder of the credit/debit card used to pay for the reservation, herein referred to as the “Guest.” This Agreement is entered into on the date when Guest places the reservation and the reservation is 100% paid in full by Guest, accepted by the Owner, and confirmed to Guest via email.

 

House-specific regulations listed below, followed by the entire rental agreement that includes house rules for all properties. By booking, you agree to all these terms. Directions, address and house manuals will be sent after booking.

Parking: 3 cars max, but it's in a public parking lot with no guarantees of availability. Max guests: 6. Ensure you understand that one bedroom is part of the open floor plan and does not have a door.

Snow tires, 4WD, or AWD with snow tires recommended in winter but there is a snow lot you can park in and walk about 5 minutes to home during huge storms (the hill is steep). Non-standard check-in at 4pm or later and check-out at 9am or earlier.

Wood Shed (1br) - 2112 Eagle Cliff Road Garage Apartment, Estes Park, CO

Sanborn Sanctuary (4br) - 641 Sanborn Drive, Estes Park, CO 

Parking: 3 cars max in front of garage. Max guests: 10. 

STANDARD CHECK-IN/CHECK-OUT TIMES: Unless specifically noted above, self check-in is 4pm or later and self check-out is 10am or earlier. We cannot accommodate early check in and late check out.

HOUSE RULES: No loud conversation/music on the deck or yard. No parties. No loud noises in hot tub because neighboring cabin is nearby. No smoking in any homes. Pets not allowed unless specifically mentioned above. Absolutely no illegal downloading of movies/torrents/songs/etc. You will be reported if this happens. No exterior wood fires, camp fires or fire pits on property or in neighborhood. Don’t feed or approach wildlife! Use a winter capable car (AWD, 4WD, or snow tires or chains) during snow months. It's highly recommended at all properties and MANDATORY at others as mentioned above. No inappropriate conduct, including but not limited to violence, verbal or physical abuse, violating any part of this Agreement, loud music, repetitive noise that disturbs others, unauthorized services, programs or gatherings, etc.

 

RENTER REQUIREMENTS: Guest must inform his invitees of all provisions of this Agreement. Guest assumes all liability should any of his invitees break any provision of this Agreement. Guest accepts that the Owner only rents to responsible adults over the age of 25 years of age.

 

OCCUPANCY REQUIREMENTS: The maximum occupancy (total number of people, regardless of age) of the property set by the Owner’s vacation rental operating permit, as dictated by local authorities and Law. Maximum occupancy is listed above. If more people than allowable are at this property, the Guest will be in breach of this Agreement, and Owner will notify Law Enforcement to remove all persons from the property and charge a fine of $1000 and will retain and not refund the entire rental amount. 

GUEST COUNT: No more than the number of people stated on the reservation shall occupy the premises at any time. Should occupancy change, Guest must notify Owner, receive approval, and pay the additional guest fee posted on the booking website. An unauthorized number of people at the rental at any time will result in a double charge for each additional guest or a maximum occupancy charge (whichever is more), in addition to additional damage, disturbance, and cleaning charges. Guest must inform Owner or his agent of any change in the number of occupants before arrival to avoid these charges. No exceptions or refunds are given for changes in the number of occupants after reservation begins.

 

CANCELATION: The standard cancellation policy is as follows: cancellations up to 60 days prior to stay will receive a refund of all monies paid. Cancellations 31 to 60 days prior to stay will receive a refund of 50% of all monies paid. Cancellations 30 days or less prior to stay will receive no refund of monies paid. There are no refunds for early departure. Additionally, full refunds will be granted for bookings that need to be cancelled because the property is ordered to be shut down by town, county or state authorities (eg, local closures due to coronavirus). If the property is legally allowed to operate, the standard cancellation policy applies.

 

GUEST CONDUCT: The rental is not intended for parties, nor gatherings of anyone except those included on the reservation. If there is excessive noise or music, any illegal activity, or evidence of violation of any policy in this document, Guest may be asked to vacate the premise without any refund and additional charges may be assessed at the Owner’s discretion. 

 

NO SMOKING: Smoking is not allowed on the property. If Guest or his invitees are in breach of this prohibition, Guest agrees to leave without refund and pay a deep cleaning, odor removal and sanitation fee of $750.

NO PETS: Pets are not allowed on the property unless specifically noted above in the house-specific rules. If Guest or his invitees are in breach of this prohibition, Guest agrees to leave without refund and pay a deep cleaning, odor removal and sanitation fee of $750.

 

PARKING: Parking is limited to the number of vehicles and the specific parking spots assigned to Guest as described at the top of this Agreement. Parking anywhere else, or with more cars than allowable, will result in vehicle being towed at Guest expense.

 

CLEANING AND LINEN SERVICE: A non-refundable cleaning fee is included with all reservations. Guest and invitees are still required to follow all check out procedures detailed in this Agreement and leave the property in the same general and good habitable condition it was at arrival. Undue and/or unreasonable cleaning shall be charged as an Additional Cleaning Charge at a rate of $50/hour, with a one hour minimum. This also applies to the property exterior, grounds, BBQs and hot tubs (if so equipped). Guest understands there is no daily cleaning service. The home is provided with a starter set of toilet paper. Owner does not guarantee that toilet paper, paper towels or any extra items will always be available and Guest may need to replenish them on their own.

 

CHECK-OUT PROCEDURES: Guest agrees to abide by checkout procedures that are sent via email after booking. They will include starting a load of towels and wash cloths if the unit has a laundry machine, doing dishes (load and run dishwasher or do dishes by hand if no dishwasher) and replacing key in lockbox if so equipped, among other duties.

 

UNAUTHORIZED EARLY CHECK-IN & LATE CHECK-OUT: Unauthorized early check-in is deemed to be a trespass and may be subject to the cancellation of the reservation and forfeiture of all deposits paid. Departing later than agreed upon check-out time is considered holding over, and unauthorized holding over by Guest will be subject to a charge of 300% of invoiced nightly rate, plus any additional damages incurred such as the cost of alternate housing for guests displaced by Guest holding over, which shall be billed to the Guest’s credit card. If Guest or his invitees are not present when cleaning crews arrive and have left their possessions in the house, cleaning crews will remove them in order to prepare the unit for incoming Guest and Guest will be charged $150 for this service. PLEASE checkout promptly -- the cleaning crews have a very short time window to prepare the unit for new Guest.

 

WEATHER, FIRE, STORMS AND ACTS OF GOD: There are no refunds for storms, fires, power outages, snow conditions, road conditions, flight conditions, acts of god, or other conditions, even if a mandatory evacuation is ordered or if roads, airports, etc. (private or public) are closed and/or unpassable. Guest is advised to purchase supplemental travel insurance to mitigate these risks. 

 

DAMAGE, MISSING ITEMS, INSURANCE: Guest will be completely responsible for any and all damage to the home, property, furniture and amenities caused by Guest or his invitees, whether accidental or due to Guest negligence. Guest is also responsible for replacement cost of any missing items reasonably attributed to Guest or invitees. Guest understands that housekeepers take video inventory before and after each reservation. Guest understands that optional rental insurance can be purchased to mitigate cost of missing or damaged property of Owner. If insurance is purchased, Guest must notify the owner and assist the owner in making a claim. 

 

GUEST PERSONAL PROPERTY: Guest understands that any personal property of and used by Guest is not insured by Owner and Owner shall not be responsible for any lost, stolen or missing property of the Guest, or property of Guest left after check out.

 

CHILD PROOFING: Guest understands that no special efforts have been made to “childproof” this house, and accepts the risk or harm to any children in or on the property, hot tub, street, or surrounding wilderness, forest, open space or adjacent property.

 

ENTRY AND INSPECTION: Owner and owner’s employees, contractors and agents shall have the right to enter the Property at any time, without permission, in case of emergency or imminent danger of damage to building or property. Owner and owner’s employees, contractors and agents shall further have the right to enter the Property upon four (4) hour notice (or such shorter time period as may be agreed to by Guest), to make necessary or agreed repairs, decorations, alterations, improvements, or to supply necessary or agreed-upon services, and/or inspect the condition of the Property. 

 

PROPERTIES FOR SALE: If the Property is listed for sale, Owner retains the right to enter the premises and to allow prospective or actual buyers, lenders, real estate agents, building inspectors, or anyone else related to the property sale to enter the Premises upon twenty-four (24) hours prior notice to Guest.  

 

SURVEILLANCE EQUIPMENT: Guest accepts that there are exterior security cameras to protect the property from potential break-ins and theft and to deter parties and identify nonpaying/nonregistered occupants or additional invitees. There are NO cameras inside the house. There are decibel meters inside the house that record noise levels and alert the Owner if noise exceeds a specific threshold deemed irritable to neighbors. PESTS: The town is in a wild area, and the property is close to wilderness land, a national park and national forest land. This is not an urban area. The Owner performs regular pest control but does not guarantee the home or property to be free of bugs, animals or other pests, nor does Owner cannot compensate for presence thereof. 

 

KEYS: Lost keys, if used, will incur a lock change fee of $150.

 

SUBLETTING: Guest is not authorized to let or sublet all or any part of the premises.

 

CONDITION OF PROPERTY: The property is fully furnished and includes the amenities listed on the online website where the reservation was booked. Owner has, to the best of his ability, given an accurate description of the property and its condition. Guest understands that it is reserved "sight unseen.” Electrical, plumbing and appliances should be in working order. The failures of operation of extra amenities, including but not limited to hot tubs, TVs, cable, games, or the Internet and WiFi service are not a basis for refunds. Owner will make every effort to have these items repaired but does not guarantee that they will be repaired during Guest occupancy due to holidays, weekends, unavailable tradesmen or repairmen, etc. If the house has not been cleaned to normal standards upon arrival, Guest must notify the Owner immediately. Under no circumstances will any of the rental money be refunded or returned because of the condition of the house. The Guest agrees to hold the Owner harmless from any liability for the condition of the house or the property on which it sits. 

 

SNOW REMOVAL: Guest understands that roads and parking lots may not be snow plowed at times opportune for Guest, and snow on walkways, parking areas and steps surrounding home are to be shoveled by Guest. Homes are equipped with snow shovels. Further, Guest understands that Owner has no control over the condition of the roads and will not be held liable for any changes to road conditions (or inaccessibility due to said road conditions) or any road closing as ordered by any official agency.

 

HOT TUB (IF APPLICABLE): A hot tub carries risk that may result in serious injury or death. Unsupervised use by children is prohibited. Elderly persons, people on medication, pregnant women, infants and anyone subject to heart disease, diabetes, low or high blood pressure, strokes, epilepsy or similar should not enter the hot tub. Do not use the hot tub while under the influence of drugs or alcohol. Do not walk on hot tub cover. There is no lifeguard on duty. The hot tub water shall be balanced and sanitized before your arrival, and an active sanitizing system shall be employed. However, Owner is not responsible for any injury, skin disorder, infection or death to Guest or his invitees arising from hot tub use. Improper guest use and introduction of foreign substances can overrun the sanitizing system. To ensure water sanitation during occupancy, Guest and his invitees must follow these rules, no exceptions whatsoever: shower before and after use, do not introduce any foreign substances into hot tub (ie, no food, drink, alcohol, bodily fluids, plants, animals, or anything other than the freshly bathed bodies of Guest and invitees), and shock hot tub with provided chemicals and secure lid with wind straps after every single use. Leaving the lid open invites animals or plant material that cause overrun the sanitation system. Owner is not responsible for ANYTHING resulting from failure to follow these rules. Should shocking chemicals run out, Guest must contact Owner or owner’s agent for more before using hot tub again.

 

INDEMNIFICATION AND WAIVER: Guest will indemnify, defend and hold harmless Owner and his employees and agents from all claims, disputes, litigation, judgments, costs and attorney fees resulting from loss, damage or injury to Guest, Guest’s guests or licensees or their personal property arising out of the Guest or the Guest’s guests, invitees and licenses occupancy or use of the Property. Neither Owner nor his agents and employees shall be liable for any damage or injury to Guest, or any other person, or to any property, occurring on the Property. Guest agrees to hold Owner and his agents and employees harmless from any claims for damages or injury. Guest agrees to waive and release the Owner and his agents and employees (“Released Parties”) from any and all liability for costs, expenses or damages due to loss of property or for personal injuries or death which may occur to Guest and/or Guest’s guests and licensees while on or about the Property. Guest hereby assumes the risk of a Claim while using the Property. The waiver and release is intended to be a full and complete waiver and release of the Released Parties from any and all present or future Claims (known or unknown). Guest and his invitees understand that the Owner is not responsible for any injury caused by slipping on pavement or surface regardless of ice, snow, gravel or other condition. Guest understands home is in rugged mountain terrain with a highly volatile climate and must use care during all seasons and weather conditions. Owner is not responsible for any personal injury or loss or damage to Guest property caused directly or indirectly from foul, inclement weather conditions, Acts of God or nature, failure of heat, accidents related to fire, heaters, stoves, Guest failure to take adequate precautions around wet, icy or slippery areas, or any unforeseeable circumstances. Under no circumstances will Guest or their Guest hold the Owner or Owner’s agents or employees responsible for any damages or claims of any kind resulting from their stay. This Agreement and disclaimer applies to Guest and all guests/invitees in the Guest’s party.

ERRORS AND OMISSIONS: All information about the property is not guaranteed. Owner is not responsible for errors or omissions in website listing. All information provided on the online listing was posted to the U.S. English version of the website and owner is NOT responsible for any translation errors. Guest agrees this policy supersedes online booking platform policy.

  

RELATIONSHIP OF PARTIES: It is specifically agreed and understood that the relationship between the parties herein shall be deemed to be of proprietor and lodger or proprietor and guest, as opposed to a relationship of landlord and tenant. Guest specifically waives and make inapplicable to this Agreement the provisions of any local, state or federal Landlord/Tenant law.

 

PRIOR AGREEMENTS: No prior Agreement or understanding not contained in writing herein shall be effective. This Rental Agreement may be modified in writing only, and must be signed by the parties in interest at the time of the modification. It constitutes the entire Agreement of the parties. If any provision in this Agreement is held by any court to be invalid, void or unenforceable, the remaining provisions shall nevertheless continue in full force.

ATTORNEYS FEE/DEFAULT: In any action or proceeding involving a dispute between Owner and Guest arising out of this Agreement, the prevailing party will be entitled to reasonable attorneys’ fees and any costs incurred in enforcing this Agreement.

 

FORUM SELECTION, JURISDICTION, LAW AND VENUE: The parties agree to the exclusive jurisdiction and venue of the District Court of the State of Colorado in Larimer County for the resolution of all disputes arising under this Agreement. Guest expressly waives any other right or privilege with respect to the election of venue or court (i.e. state or federal) and location of the venue of action. 

 

GOVERNING LAW: It is expressly agreed that this Agreement shall be governed and construed by the laws of the State of Colorado only, irrespective of the state of residency of Guest.

 

REMEDIES: In the event of a default to the Agreement, Owner or his agent or employees may immediately re-enter and remove all persons and property. In such an instance, the Agreement will be terminated, and Owner shall be entitled to recover all damages allowable under the Law. The Guest hereby waives all claims for damages that might be caused by Owner re-entry and taking possession of premises or removing or storing property as herein provided, and will hold Owner harmless from loss, costs and damages occasioned thereof, and no such re-entry shall be considered or construed to be a forcible entry as defined in the Colorado Rules of Civil Procedure or other similar statutory provisions. Further, if for any reason Owner is unable to deliver possession of the premises to Guest at the commencement of the term specified in the Rental Agreement, Owner shall refund amounts paid by Guest, but shall not be liable for any other damages caused thereby.
